Terms of Service
Effective July 4, 2026 · walkie-talkie.video and the Walkie-Talkie appWe're two friends who built the app we needed, and we'd like the rules to be as simple as the product:
- Your videos are yours. We need just enough permission to store them and deliver them to the one person you sent them to. That's it. No rights grabs.
- It's a two-person space, so act like it. No harassment, no recording people who don't want to be recorded, nothing illegal.
- It's a beta. Things will occasionally wobble. We'll be honest about it when they do.
- Supporter is a normal subscription. $3.99/month through your app store, cancel anytime, and the free app stays a real app either way.
- If you leave, or we have to close an account that's abusing the place, the promises in our Privacy Policy still apply to everything you made.
The formal version below is what a court would read. It says the same things with more armor on.
What the lawyer sent back (and what you're agreeing to)
1. Agreement
These Terms are a contract between you and SpaghettiSoft, LLC, a Delaware limited liability company doing business as Walkie-Talkie (“we,” “us”), covering the walkie-talkie.video website and the Walkie-Talkie mobile application (the “Service”). By creating an account or using the Service, you agree to them and to the Privacy Policy. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 13 years old. If you are under 18, you may use the Service only with the permission and supervision of a parent or guardian who agrees to these Terms on your behalf.
3. Your account
Keep your login credentials to yourself; you are responsible for activity under your account. Tell us promptly at hello@walkie-talkie.video if you think your account has been compromised.
4. Beta status
The Service is currently a beta. Features may change, break, or be discontinued; storage limits and plan contents may be adjusted as we learn (we'll communicate material changes). The Service is provided on an as-available basis during the beta and afterward.
5. Your content
You own the videos and other content you create. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, encrypt, transmit, transcode, and display your content solely to operate and improve the Service: that is, to deliver it to the Connection you chose and play it back. This license ends when your content is deleted from the Service, except for short-lived backups. We do not acquire ownership, we do not publish your content, and we do not use it for advertising.
You are responsible for what you record and send, and you confirm you have the rights (and, where required, the consent of people appearing in your videos) to share it.
6. Acceptable use
You agree not to use the Service to:
- break the law, or infringe anyone's rights (including privacy and intellectual-property rights);
- harass, threaten, exploit, or harm anyone, including the one person on the other end of a Connection;
- send malware, spam, or content sexualizing minors (zero tolerance; reported where required by law);
- probe, overload, scrape, or reverse-engineer the Service, or access it by any means other than the interfaces we provide;
- resell or commercialize the Service without our written permission.
7. Supporter subscriptions
The Supporter plan costs $3.99/month, billed through your app store account (Apple App Store or Google Play), whose payment terms apply. Subscriptions renew automatically until cancelled in your store settings; cancellation stops the next renewal and Supporter features remain until the end of the paid period. Refunds are handled per your app store's policy and applicable law. Prices may change with advance notice, never retroactively.
8. Storage and length limits
Plans include a total stored-video limit across all your Connections (currently five videos on Free and one hundred on Supporter) and a per-video length limit (currently five minutes on Free and ten minutes on Supporter). When you exceed the storage limit, your oldest videos are permanently deleted to make room, as described in the app. If you downgrade from Supporter, content above the Free limit will roll off the same way after a grace period, so save anything you want to keep first. We are tuning these limits during the beta and will communicate changes in the app.
9. Termination
You can stop using the Service or delete your account at any time. We may suspend or terminate accounts that violate these Terms, create risk for other users, or are required to be closed by law, with notice when practicable. Sections 5 (license wind-down), 10, 11, and 12 survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that content will never be lost, so keep copies of videos that matter to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow these limits, so they may not fully apply to you.
12. Indemnity
You will defend and hold us harmless from claims arising out of your content or your violation of these Terms or the law, to the extent permitted where you live.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless the law where you live gives you the right to a different venue. Before suing anyone, please just email us; most things are fixable in one reply.
14. Changes to these Terms
If we change these Terms materially, we'll notify you in the app or by email before the changes take effect. Continuing to use the Service after that means you accept the new Terms.
